1. Agreement to Terms

By accessing or using Bantum ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

Bantum is operated by Excality ("we," "our," or "us"). These Terms constitute a legally binding agreement between you and Excality.

2. Description of Service

Bantum is an AI-powered business analyst tool that:

  • Conducts interactive conversations to gather project requirements
  • Uses artificial intelligence to analyze business needs using the BANT framework (Budget, Authority, Need, Timeline)
  • Generates comprehensive project requirements documents in PDF format
  • Delivers documents via email to the provided address

The Service is provided "as is" and may be modified, suspended, or discontinued at any time without notice.

3. User Registration and Account

To use Bantum, you must provide:

  • Your full name
  • A valid email address
  • Your company name (optional)

You agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of any session data and for all activities that occur under your sessions.

4. User Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information.

By using Bantum, you consent to:

  • The collection and storage of your conversation data
  • Processing of your information by AI/LLM providers
  • Storage of your data on Firebase and Google Cloud Platform
  • Receipt of project documents via email

5. Intellectual Property Rights

5.1 Service Content

All content, features, and functionality of Bantum (including but not limited to text, graphics, logos, software, and design) are owned by Excality and protected by copyright, trademark, and other intellectual property laws.

5.2 User Content

You retain ownership of the information you provide during conversations. However, by using the Service, you grant us a worldwide, non-exclusive, royalty-free license to:

  • Process and analyze your input to generate requirements documents
  • Use anonymized data to improve our AI models and Service quality
  • Store conversation history for service functionality

5.3 Generated Documents

The project requirements documents generated by Bantum are provided to you for your business use. You may use, modify, and distribute these documents as needed for your projects.

6. Prohibited Uses

You agree not to use the Service to:

  • Violate any applicable laws or regulations
  • Infringe upon intellectual property rights of others
  • Transmit malicious code, viruses, or harmful data
  • Attempt to gain unauthorized access to the Service or its systems
  • Reverse engineer, decompile, or disassemble the Service
  • Use automated systems (bots, scrapers) without permission
  • Impersonate others or provide false information
  • Harass, abuse, or harm other users or our staff
  • Use the Service for illegal activities or fraudulent purposes
  • Overload or disrupt the Service infrastructure

7. Service Limitations and Disclaimers

7.1 AI-Generated Content

Bantum uses artificial intelligence to analyze information and generate requirements documents. While we strive for accuracy, AI-generated content may contain errors, omissions, or inaccuracies. You are responsible for reviewing and verifying all generated documents.

7.2 No Professional Advice

The Service provides information and document generation tools but does not constitute professional business advice, legal advice, or consulting services. You should consult with qualified professionals for specific business decisions.

7.3 Availability

We do not guarantee that the Service will be available at all times or free from interruptions, delays, or errors. We reserve the right to modify, suspend, or discontinue the Service at any time.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • Excality shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service
  • Our total liability for any claims related to the Service shall not exceed $100 USD
  • We are not responsible for any business decisions made based on AI-generated content
  • We are not liable for data loss, though we implement reasonable backup procedures

9. Indemnification

You agree to indemnify, defend, and hold harmless Excality and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Your provision of false or misleading information

10. Termination

We reserve the right to terminate or suspend your access to the Service immediately, without prior notice, for any reason, including:

  • Violation of these Terms
  • Fraudulent or illegal activity
  • Abuse of the Service or its infrastructure
  • Request by law enforcement or government agencies

Upon termination, your right to use the Service will immediately cease. You may request deletion of your data by contacting us at privacy@excality.com.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where Excality is registered, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the Service shall be resolved through:

  • Good faith negotiation between the parties
  • If negotiation fails, binding arbitration in accordance with applicable arbitration rules
  • The prevailing party in any dispute shall be entitled to recover reasonable attorneys' fees

12. Changes to Terms

We reserve the right to modify these Terms at any time. When we make changes, we will:

  • Update the "Last updated" date at the top of this page
  • Post the updated Terms on our website
  • Notify users of material changes via email or Service notification

Your continued use of the Service after changes take effect constitutes acceptance of the modified Terms.

13. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Excality regarding the Service and supersede all prior agreements.
